This agreement ("Terms") is made between PT Gumugu Teknologi Kreatif ("Gumugu", "we") and the institution or individual using the Gumugu platform ("you"). By accessing or using the Services, you represent that you have read, understood, and agreed to these Terms.
Acceptance of Terms
By registering an account, accessing, or using the Gumugu platform in any way, you agree to be bound by these Terms. If you are acting on behalf of an institution, you represent that you have the authority to bind that institution to these Terms.
You must be at least 18 years old or have parental/guardian consent to use the Services. Use of the Services by institutions on behalf of those under 18 is permitted in accordance with applicable terms.
These Terms apply alongside our Privacy Policy. We encourage you to read both before using the Services.
Description of Service
Gumugu provides a cloud-based institution management platform comprising the following products:
School and campus management: student data, academics, finance, and parent communication
Pesantren management: santri, dormitories, memorization, fees, and parent communication
Paperless office: correspondence, digital approvals, forms, and document archive
LMS platform: course management, certification, and business analytics
Gumugu reserves the right to modify, add, or discontinue features of the Service at any time with reasonable notice to users.
Account & Access
3.1 Account Creation
- You must provide accurate, complete, and current information when registering
- Each institution is permitted only one primary account unless otherwise agreed
- You are responsible for maintaining the confidentiality of your account credentials
3.2 Account Responsibility
- You are responsible for all activity that occurs under your account
- Immediately notify Gumugu if you suspect unauthorized access to your account
- Gumugu is not liable for losses resulting from your failure to secure your account
3.3 Sub-User Access
Account administrators can create and manage sub-user accounts for staff, teachers, or other users within the institution. Administrators are fully responsible for the actions of all sub-users under their institutional account.
Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. The following are expressly prohibited:
Attempting to access systems, accounts, or data you are not authorized to access
Taking actions that disrupt or damage Service availability
Uploading or distributing content that is illegal, harmful, or infringes third-party rights
Attempting to decompile, hack, or reverse engineer the Gumugu platform
Using Gumugu APIs for unauthorized purposes or exceeding usage limits
Reselling, sublicensing, or distributing access to the Services without written permission from Gumugu
Violations of acceptable use terms may result in account suspension or termination without notice and without refund.
Data Ownership
Data you enter into the Gumugu platform belongs entirely to you. Gumugu makes no claim of ownership over institutional data, student, santri, document, or any content you create.
5.1 Data License
You grant Gumugu a limited, non-exclusive license to access, process, and store your data solely for the purpose of providing the Services. This license ends when you discontinue use of the Services.
5.2 Data Export
You can export your data at any time in a machine-readable format (CSV, Excel, or JSON). Export features are available across all Gumugu products at no additional cost.
5.3 Data Deletion
When your account is terminated, your data will be retained for 90 days to allow for recovery. After this period, all data is permanently deleted from our systems, unless otherwise required by law.
Payment & Subscription
6.1 Pricing & Billing
- Service pricing is stated in the agreed offer or subscription agreement
- Bills are issued at the beginning of the subscription period (monthly or annual)
- Payment can be made via bank transfer, VA, QRIS, or other agreed methods
- Prices exclude applicable taxes (VAT) in Indonesia
6.2 Late Payment
Payments more than 14 days past due may result in service suspension. Gumugu will provide at least 7 days' warning before suspension.
6.3 Refunds
Gumugu does not provide prorated refunds for mid-period cancellations, except:
- Gumugu unilaterally discontinues the service without valid reason
- A significant service failure occurs (downtime exceeding 72 consecutive hours)
- Otherwise specified in a signed subscription agreement
6.4 Price Changes
Gumugu may change Service pricing with a minimum of 60 days' notice before changes take effect. Price changes do not apply retroactively to already-paid periods.

Gumugu does not guarantee uninterrupted availability of the Services. We will make every effort to minimize downtime and will communicate known disruptions to users.
Intellectual Property
8.1 Gumugu's Rights
The Gumugu platform, including all code, design, logos, trademarks, and content developed by Gumugu, is the exclusive property of PT Gumugu Teknologi Kreatif and is protected by applicable intellectual property law.
8.2 Usage License
Gumugu grants you a limited, non-exclusive, non-transferable license to use the Services during your subscription term. This license does not include the right to copy, modify, distribute, or create derivative works from the Gumugu platform.
8.3 Your Rights
You retain all rights to content, data, and intellectual property you upload or create within the Gumugu platform. Use of the Services does not give Gumugu any claim over your intellectual property.
8.4 Feedback
If you provide suggestions, ideas, or feedback about the Services to Gumugu, you grant Gumugu a royalty-free license to use that feedback without obligation to you.
Limitation of Liability
Services are provided 'as is' and 'as available'. Gumugu makes no express or implied warranties regarding the accuracy, reliability, or fitness of the Services for a particular purpose.
To the extent permitted by applicable law, Gumugu is not liable for:
- Indirect, incidental, or consequential damages arising from use or inability to use the Services
- Data loss caused by your own actions or negligence
- Losses due to unauthorized access to your account caused by your failure to secure credentials
- Service disruptions caused by force majeure, including natural disasters, third-party network disruptions, or government regulations
Gumugu's total liability to you will not exceed the amount you paid to Gumugu in the 12 months preceding the claim.
Termination
10.1 Termination by You
You may terminate your subscription at any time by contacting our team at support@gumugu.com or through account settings. Termination will take effect at the end of the current subscription period.
10.2 Termination by Gumugu
Gumugu may terminate your account with 30 days' notice for any reason. Gumugu may terminate without notice if:
- You materially breach these Terms
- You use the Services for illegal activity
- You fail to pay invoices within 30 days of the due date
10.3 Effect of Termination
Upon termination, your access to the Services will be suspended. Your data will be retained for 90 days before permanent deletion, giving you time to export necessary data.
Governing Law & Dispute Resolution
11.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.
11.2 Dispute Resolution
Any dispute arising from or relating to these Terms will be resolved through:
The parties will attempt to resolve the dispute through good-faith negotiation for 30 days.
If negotiation fails, the dispute will be resolved through mediation with a mutually agreed mediator.
If mediation is unsuccessful, the dispute will be resolved in the competent District Court in Banda Aceh, Indonesia.
